This is an English translation of the German-language "Allgemeine Geschäftsbedingungen" provided for convenience. In the event of any discrepancy, the German original (available here) prevails, as set out in Section 1.
These Terms of Service ("Terms") govern the use of the "Claim" app and website (Wallet, Marketplace and all related features, together the "Service"). The Service is operated by claim-app GmbH, Magnolienpark 13, 4052 Basel, Switzerland (Commercial Register of the Canton of Basel-Stadt, UID CHE-210.608.233), represented by Marcel Mutschler ("we", "us", "Claim").
Claim is available to users worldwide for registration and the Wallet feature, and currently supports 29 national currencies for price display and subscription billing. Participation in the Marketplace (buying, selling, optional mail delivery), however, is limited to users resident in, or with a delivery address in, Switzerland or the EU/EEA (see Section 3.2). The German-language original of these Terms is exclusively authoritative for the conclusion of the contract; this and any other translated version is provided for convenience only. By registering an account, you agree to these Terms.
Digital management of vouchers via photo scan with AI-assisted, automatic text recognition (provider, value or service, expiry date, code, address where available). Recognised information must be reviewed before saving (see Section 5). Free to use for up to 5 simultaneously active vouchers; beyond that, Claim Premium is required (Section 13).
A brokerage platform for unused vouchers in the categories Restaurant, Hotel, Wellness & Beauty, Sport & Leisure, Shopping & Retail, and Other, available either via Offer or Instant Purchase. Vouchers in the Culture & Entertainment category, as well as date- or seat-bound tickets (e.g. concert, event or travel tickets for a fixed date or seat), are excluded from the Marketplace, as they cannot be redeemed as flexibly as typical vouchers or carry a higher resale risk; they can, however, still be managed in the Wallet. Claim acts exclusively as an intermediary ("marketplace facilitator") and at no point becomes a party to the purchase contract between users; that contract is concluded exclusively between the Seller and the Buyer. Use of the Marketplace is limited to users resident in Switzerland or the EU/EEA; the country selection in the profile and in the order form for optional mail delivery (Section 9) accordingly includes only these countries.
Where an address has been provided, Marketplace listings are displayed on a map. The map is powered by freely available mapping services (OpenStreetMap/Nominatim); your own device location is processed only locally in your browser for this purpose and is never stored on our servers.
Anyone who shares their personal invitation code and successfully invites another person receives, together with that person, a one-time reduced brokerage fee (see Section 14).
You agree to:
An Offer is a non-binding expression of intent; a purchase contract is concluded exclusively between Buyer and Seller only once the Seller expressly accepts the Offer. Alternatively, a voucher may be acquired directly at the listed price via Instant Purchase – in that case the purchase contract is concluded upon completion of the purchase process. Following acceptance of an Offer or an Instant Purchase, the voucher is reserved and locked for other prospective buyers for 30 minutes; if payment is not completed within this period, the reservation automatically lapses and the voucher becomes available again. The digital code and ownership of the voucher transfer to the Buyer only upon confirmed payment.
Payment is processed through our payment provider Stripe using the "destination charges" model (Stripe Connect): the Buyer pays the full price, and Stripe forwards it, after deducting the fees described in Section 8, directly to the Seller's Stripe account. Claim never itself receives the purchase price and does not become a payment service provider within the meaning of financial market law.
Important note on foreign currencies: voucher values and listing prices are displayed in the app in the currency stored for the respective voucher. Actual payment processing via Stripe is carried out in that same voucher currency, not necessarily in Swiss francs (CHF) – the amount charged corresponds to the displayed price. Where the Seller's home currency (based on the country stored in their profile) differs from the voucher currency – for example where a voucher is resold from a country other than the Seller's own country of residence – an additional currency-conversion surcharge applies, borne by the Buyer (see Section 8). Supplementary conversions into your preferred currency shown in the security/calculator example and the map view (ⓘ icon) are provided for information only and are based on the most recently available, non-guaranteed exchange rates. The amount displayed immediately before payment is initiated in the checkout/offer flow is the binding amount. Claim Premium subscriptions, by contrast, are genuinely billed in the selected national currency (see Section 13).
Two separate fees are withheld from the Seller, automatically deducted before payout and shown in the app. Where the Seller's home currency differs from the voucher currency (see Section 7), a third position applies, borne by the BUYER, which does not reduce the payout to the Seller:

We will announce any change to the brokerage fee at least 30 days in advance within the app. Offers already accepted before such a change are not affected by it.
In addition to the digital code, which is available immediately, the Buyer may choose, at the time of the Offer or Instant Purchase, to have the Seller additionally send the physical original voucher by post, to a delivery address of the Buyer's choosing within Switzerland or the EU/EEA (see Section 3.2). Where the chosen delivery country matches the Seller's own country, a domestic shipping fee applies; where it differs, a higher international fee applies instead – in both cases based on the Seller's own country, since that is where the item is actually shipped from, regardless of the country in which the underlying voucher is redeemable. Both fees are determined by the Seller's national currency (shown during the purchase process) and are paid in full – without deduction of the brokerage fee or any currency-conversion surcharge under Section 8 – to the Seller as compensation for their effort.
The Seller undertakes to send the original voucher promptly after payment is received and to enter the tracking number in the app. If this has not occurred within 3 days, Claim automatically reminds the Seller; if shipment still has not occurred, with a tracking number on file, within 10 days, the Buyer is notified and may flag the matter via "Report a Problem" (Section 11). Sole liability for loss, damage or delay in the postal system, as well as for the authenticity and redeemability of the shipped original, rests with the Seller; Claim is not involved in the physical shipment and assumes no warranty in this regard.
Claim employs technical measures against duplicate sales, including a block on exact duplicate registration of voucher codes and an automated similarity check for codes that are highly similar but not identical (e.g. due to text-recognition errors). Flagged matches are reviewed manually by a person internally; no automated decision with direct legal effect is made without human review. These measures do not replace users' duty of care under Section 5 and do not create any entitlement to error-free operation.
If a purchased voucher does not match its description, has already been redeemed, is invalid, or was not shipped as agreed under Section 9, this can be reported via "Report a Problem" in the app. We review reports to the best of our knowledge and may, at our discretion, mediate between the parties, for example by recommending a refund from the Seller; because Claim is not itself a party to the purchase contract, there is generally no claim against Claim for a refund, without prejudice to statutory claims against the other user. For consumers resident in the EU/EEA, the mandatory provisions of their country of residence apply in addition.
Following an accepted Offer or Instant Purchase, the Buyer may rate the Seller (1–5 stars plus an optional comment), visible on the Seller's profile. Ratings must be factual and truthful; we may remove ratings that are manifestly abusive or unlawful.
Claim Premium removes the 5-voucher limit on simultaneously active vouchers in the Wallet. The price is CHF 0.99 per month, or the equivalent shown in the app in one of the 29 supported national currencies, genuinely billed via Stripe Billing in the currency actually selected (a real foreign-currency charge, unlike the informational display for Marketplace purchases under Section 7). The subscription renews automatically for a further month unless cancelled in time. Claim itself is the contracting party. Cancellation is possible at any time, effective at the end of the current billing period, via the Stripe customer portal in the app; amounts already paid for the current period are not refunded on a pro-rata basis, to the extent permitted by law. Users resident in the EU/EEA additionally have the statutory right of withdrawal under Section 19.
Anyone who successfully refers another person using their personal invitation code receives, together with the invited person, a one-time reduced brokerage fee of 2% instead of 4% on their respective next sale. Multiple redemptions of the same discount, self-referral, and combination with other discount promotions are excluded. We reserve the right to reverse referral benefits obtained through abuse.
The app, its design, software and editorial content are the property of Claim or duly licensed to it and protected by copyright. You are granted a simple, non-transferable right to use the Service for its intended private purpose. For content you upload (e.g. voucher photos, profile picture), you grant Claim a simple right to process it solely for the purpose of providing the Service (display in Wallet/Marketplace, text recognition); you warrant that you are entitled to grant this right.
We aim to provide the Service as reliably as possible but do not guarantee any particular level of availability. We reserve the right to carry out maintenance, further develop the Service, and discontinue individual features; where reasonable, we will announce material restrictions with reasonable advance notice.
You may have your account deleted at any time via the app; personal data will be removed or anonymised and your login permanently blocked (see Privacy Policy for details). Completed sales/purchases remain referenceable in anonymised form. We reserve the right to suspend accounts immediately for serious or repeated breaches of these Terms.
Sole liability for the authenticity, validity, redeemability and transferability of listed vouchers, as well as for proper performance of the purchase contract, rests with the offering party or the respective contracting party. No warranty is given for the accuracy or completeness of the automatic text recognition or the similarity check under Section 10. Claim is not liable for outages, errors or delays caused by our payment provider Stripe, our mapping provider, or other third-party providers we engage, to the extent these are outside our control. To the extent permitted by law, our liability is limited to intent and gross negligence; this does not apply to damages arising from injury to life, body or health, nor where mandatory law – in particular mandatory consumer protection law at the place of residence of users in the EU/EEA or elsewhere – provides otherwise.
Consumers resident in the EU/EEA generally have a 14-day right of withdrawal for contracts concluded online. For Claim Premium, this right expires early once you expressly consent to immediate performance and acknowledge that doing so extinguishes your right of withdrawal (confirmed during the order process). For the purchase of digital voucher codes via the Marketplace, the right of withdrawal expires upon full performance of the contract, provided you have consented to early performance, since the code is transferred immediately upon payment. For the optional physical mail delivery under Section 9, the general rules on withdrawal from contracts between private individuals apply, to the extent applicable; since Claim is not a party to that contract, any withdrawal – where legally provided for – should be directed to the Seller.
We are not obliged, and are generally not willing, to participate in dispute resolution proceedings before a consumer arbitration body; we reserve the right to participate voluntarily on a case-by-case basis. The EU Online Dispute Resolution platform was discontinued by the European Commission as of 20 July 2025 and is no longer available. For disputes between Buyer and Seller on the Marketplace, the internal "Report a Problem" process under Section 11 is the primary avenue.
We reserve the right to amend these Terms, in particular to reflect new features, new markets or legal developments. We will notify you of material changes with reasonable advance notice of at least 30 days, via the app or by email. If you do not object within this period, the change is deemed accepted; for each material change we will separately draw attention to this right of objection and the consequences of not exercising it.
These Terms are governed by substantive Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law. The place of jurisdiction is Basel-Stadt, Switzerland, to the extent permitted by law. For users resident in the EU/EEA, mandatory consumer-protection provisions of their country of residence remain unaffected, including the possibility to bring proceedings at their own place of residence. For users resident outside Switzerland and the EU/EEA, mandatory, non-waivable consumer-protection provisions of their respective country of residence, to the extent applicable under local law, likewise remain unaffected; otherwise the choice of law above applies.
